The bench, also comprising Justices P.S. Narasimha and J.B. Pardiwala, also accepted AAP's plea that after the Mayor gets elected, he/she would preside over the elections of Deputy Mayor and members of the Standing Committee, and not the pro-tem presiding officer.

The CBI on Friday moved the Rouse Avenue District Courts seeking permission to interrogate him in the matter, and the court allowed its plea. The CBI interrogated Jain about scam accused Vijay Nair and other related things. The CBI has already filed a charge sheet in the matter, and sources said that they are in process of filing a supplementary charge sheet in the matter and hence they wanted to collect more evidence to make the case water-proof.

"BJP believes that when a matter is sub judice, we should not react on any observation made in the courtroom, ot outside it and especially avoid media trial," state General Secretary Harsh Malhotra said. BJP's mayoral candidate Rekha Gupta has moved a intervention application in the matter and we will now present our contention before the court itself, he added.

Sisodia said: "LG's allegations are completely baseless and cheap politics, which he does best. On one hand, he has withheld every single file of the Delhi government, on the other he is accusing us of not letting him demolish temples? The LG's actions raise doubts over his priorities. Why is he so keen to run bulldozers over temples in Delhi. He said it is deeply unfortunate.

Sisodia said, "The L-G has once again defied the Constitution and the Supreme Court and illegally overturned a decision of the elected government of Delhi. The L-G illegally exercised the power of 'difference of opinion' and overturned the decision of the cabinet of the Delhi Government regarding the appointment of professional directors in power DISCOMS four years ago. The L-G has no right to overturn the decisions of the Chief Minister and the cabinet of the elected government".

She also said that as per the DMC Act aldermen are eligible to vote in the mayor, deputy mayor polls. If the CM and Education Minister have decided to send their teachers abroad, then how can LG scuttle it by repeatedly raising flimsy objections. It is against democracy and the Constitution that an unelected individual is deciding and altering almost every decision of a democratically elected government."
