Delhi HC to hear plea related to PM CARES Fund on Nov 18
The petition is filed by Samyak Gangwal, who sought to declare the PM CARES Fund a "State" under the Constitution and asked it to refrain from using Prime Minister of India or Prime Minister including its abbreviations in its name, and on its website. The plea further sought that Fund to refrain from using State Emblem of India on its website, Trust Deed, and other official /unofficial communications and advertisements.

The judge, however, at this stage, refused to comment if the speech falls under the ambit of Section 124A (sedition) of the Indian Penal Code, saying that the same requires deeper analysis. "Thus in view of settled position of law, the issue whether the said speech would fall within ambit of of 124A IPC or not, requires a deeper analysis at an appropriate stage," the order read.

Objecting to the new IT rules, WhatsApp claimed that they are forced to 'track' the origin of messages received through the network. According to reports, the Mark Zuckerberg-owned platform filed the petition on May 25, the last day to comply with the new criteria.

The court concerned shall not mechanically extend the period of custody for a maximum period of 15 days as prescribed under Section 167(2) of the CrPC, he said.
Delhi HC junks plea against Asthana's appointment as Delhi Police chief
Asthana had told the Delhi High Court that the PIL challenging his appointment is either personal vendetta or a proxy war under the cloak of public interest litigation. He contended that there is a sustained social media campaign against him and the plea before the high court was an abuse of process of law. An intervention application filed by NGO 'Centre for Public Interest Litigation' through advocate Prashant Bhushan also challenged Asthana's appointment as the Delhi Police chief.
'Not granting stay': HC declines relief to Abhishek Banerjee in PMLA case
Abhishek Banerjee, nephew of West Bengal Chief Minister Mamata Banerjee, and his wife Rujira Banerjee, have challenged the September 10 summonses. Justice Yogesh Khanna said: "Let me be very clear. I am not granting any stay. I am issuing notice." He added that the court will issue notice and then the parties can file their reply in the matter.
Delhi HC issues notice on plea challenging Asthana's appointment as top cop
Advocate Prashant Bhushan, representing Centre for Public Interest Litigation (CPIL), submitted before a bench comprising chief justice D.N. Patel and justice Jyoti Singh that the petitioner has directly copy pasted from its plea filed at the top court. He stressed that this is violation of the Delhi High Court Rules. The counsel for the petitioner denied any copy paste job. Solicitor General Tushar Mehta, representing the Centre, contended that it seems too much of a coincidence, even typographical errors are the same.

A bench, headed by Chief Justice N.V. Ramana, said: "There are issues, one is about my participation in my matter as one ground. I have expressed my views about this gentleman in CBI selection." He said that the second issue is that somebody had filed a plea against his appointment, which is pending in the high court. The Chief Justice had objected to the appointment of Asthana as the head of the CBI.

Can't prosecute good Samaritan for providing oxygen amid 2nd wave: Delhi HC
A division bench of Justices Vipin Sanghi and Jasmeet Singh observed there is no need to initiate prosecution, especially against the backdrop where both Delhi government and the Centre failed to provide sufficient medical oxygen to the people. In this case, it said, then every gurudwara, temple or church, social organisation and every good Samaritan, providing medical oxygen amid second wave, should be booked.
