Kavitha was first arrested by the Enforcement Directorate (ED) and then by the Central Bureau of Investigation (CBI) on April 11, while serving time in Tihar Jail. Judge Baweja, then, felt it appropriate to put her in CBI custody for proper interrogation.

She is now in judicial custody as part of the ongoing probe conducted by both agencies. In her application, Kavitha has claimed that her arrest was politically motivated to preclude her and her party's activities during the upcoming general elections.

She strongly claims that her involvement in the Delhi excise policy case has nothing to do with her, and it is the ruling party which has used investigation agencies to tarnish her reputation and that of her father, the former Chief Minister of Telangana.

She claims that her medical condition, hypertension, is the reason for bail. She stated that her detention by the ED has been denied proper medical care and that she requires special attention and medication.

She also claimed that the CBI case has hinged on the statements of approvers or their associates. She stated that the CBI case was part of a larger conspiracy to destroy her reputation and also that of her father.
