Haryana High Court Overturns 75% Local Reservation Law in Industries

The court's decision came in response to a petition filed by the Faridabad Industries Association and others, challenging the legality of the Act.

The Punjab and Haryana High Court recently invalidated the Haryana State Employment of Local Candidates Act of 2020, a legislation enabling 75 percent reservation in industries for local residents, just ahead of the forthcoming Assembly elections in Haryana.

The court's decision came in response to a petition filed by the Faridabad Industries Association and others, challenging the legality of the Act. Enacted on January 15, 2022, the law was a significant fulfillment of one of the major electoral pledges made by Dushyant Chautala’s Jannayak Janta Party (JJP), a key coalition partner of the BJP.

This legislation aimed to secure 75 percent reservation in the private sector for job seekers from the state, specifically targeting local youth, with a salary cap of up to Rs 30,000 per month. However, several petitions argued that this Act contradicted constitutional provisions and undermined the foundational principle of meritocracy essential for businesses to thrive and maintain competitiveness.

The petitioners contended that the Act's implementation sought to introduce a "Sons of Soil" policy, encroaching upon the constitutional rights of employers and disrupting the merit-based employment system in the private sector. They highlighted that private sector jobs historically relied on the skills and intellectual capacities of Indian citizens, based on their education and rights to work across the country.

The reservation law, slated to be effective for 10 years, also included a relaxation in residency requirements, reducing the duration from 15 to five years for individuals to obtain a bona-fide resident certificate in the state. This adjustment aimed to provide some flexibility to private companies in their hiring processes.

The High Court's decision to quash this reservation Act holds significance in the run-up to the upcoming elections in Haryana and has raised discussions about the balance between local employment preferences and constitutional principles in job reservations within the private sector.
