Allahabad High Court Upholds Farmers' Right to Choose Land Sale in Jewar

The court clarified that while the state authorities have the right to acquire the land, they must adhere to the procedures stipulated by the law.

The Allahabad High Court has issued a directive to the authorities of Gautam Buddha Nagar (Noida), instructing them not to coerce farmers in the tehsil Jewar into signing sale deeds for their land in favor of the state unless the farmers willingly agree to do so.

The court clarified that while the state authorities have the right to acquire the land, they must adhere to the procedures stipulated by the law.

A division bench, led by Acting Chief Justice Manoj Kumar Gupta and Justice Manish Kumar Nigam, resolved a mandamus writ petition submitted by Mahendar Singh and 98 other farmers. The petitioners sought to prevent the state government authorities from pressuring them into executing sale deeds for their bhumidhari land located in various villages, including Tirthali, Tirthali Kheda, Rabupura, Karauli Banger, Akalpur, Kuraib, Chakbeerampur, and Beerampur in Jewar Tehsil of Gautam Buddha Nagar district.

The farmers claimed that the state authorities were using coercion to force them into selling their land, against their will. In response, the counsel for the Yamuna Expressway Industrial Development Authority of India (YEIDA) stated that the authority had merely proposed to the landowners to sell their land for the greater public welfare. They assured that there would be no compulsion for landowners to sign sale deeds in favor of the authority, and no possession of land would be taken until both parties reached a mutual agreement on compensation, followed by the execution of title documents.
