Apple has ceased the sale of its Watch Series 9 and Ultra 2 in its U.S. retail stores, and these watches will not be available for purchase when Apple Stores reopen after Christmas. This decision is a response to an import ban imposed by the U.S. International Trade Commission (ITC) due to a patent dispute with medical device maker Masimo.
The removal of the Apple Watch Series 9 and Apple Watch Ultra 2 from Apple's online store last week has now extended to its physical locations. The ITC ruled in October that the blood oxygen sensor in these smartwatches infringes on two Masimo patents, leading to the import ban.
Starting December 26, when Apple Stores reopen, customers will not be able to purchase the Apple Watch Series 9 and Apple Watch Ultra 2. Instead, Apple Stores will promote the Watch SE, which remains available as it lacks the blood oxygen sensor.
Although the case was sent to the Joe Biden administration for a 60-day Presidential Review Period, as of now, President Biden has not intervened or vetoed the ITC decision. The Presidential Review Period officially ends after December 25, leaving open the possibility that President Biden may choose to act at the last minute.
Apple has expressed its commitment to taking all necessary measures to restore the availability of the Apple Watch Series 9 and Apple Watch Ultra 2 to customers in the U.S. The company plans to file an appeal of the ITC's final decision with the U.S. Court of Appeals for the Federal Circuit on December 26. The patent dispute between Apple and Masimo revolves around the blood oxygen sensor (SpO2 sensor) technology in the Apple Watch.
