Apple Stands Firm, Chooses Not to License Masimo's Patents Despite Watch Import Ban

Apple (NASDAQ:AAPL) has affirmed its commitment to addressing the import ban on certain Apple Watch models equipped with Masimo's blood oxygen detection technology. Apple CEO Tim Cook emphasized the company's focus on the appeals process, stating, "We're focused on appeal. There’s lots of reasons to buy the watch even without the blood oxygen sensor.”

There is speculation that if the import ban is lifted, the blood oxygen detection function may be reinstated through a software update, according to reports from Apple Insider.

In the midst of the patent infringement dispute, Masimo has expressed its willingness to settle with Apple. However, Apple has not shown any inclination towards licensing Masimo's blood oxygen detection technology.

Last month, Apple resumed the sale of the affected Apple Watch models without the blood oxygen feature, following the US International Trade Commission (USITC) ruling. A company spokesperson announced the availability, stating, “Apple Watch Series 9 and Apple Watch Ultra 2 without the Blood Oxygen feature will become available from apple.com starting 6 am PT on January 18, and from Apple Stores starting January 18.”

Apple remains steadfast in its appeal, expressing disagreement with the USITC decision and its orders. The company is actively working to comply with the ruling while ensuring customers have access to the Apple Watch with minimal disruption during the ongoing legal proceedings.

The USITC banned the sale of the new Apple watches after determining that the blood oxygen sensors infringed upon patents owned by Masimo. The resolution of this dispute remains a focal point for both Apple and Masimo.
