Senior BJP leader Subramanian Swamy moved the Delhi High Court, pleading the Union Home Ministry cancel Rahul Gandhi's Indian citizenship for allegedly claiming British nationality.
In a post on X last Friday, Swamy said he has sent in a PIL that deals with the Centre's inaction against Rahul Gandhi and made a plea for "issuance of a direction to the respondent to prosecute him by lodging an enquiry into why he should not be deprived of Indian citizenship."
Swamy's petition demands an action-taken report on his complaint against Gandhi and wants it to be heard on priority.
It was in 2019 that Swamy had written to the Union Home Ministry with a letter on Gandhi's alleged declaration of his British citizenship and the holding of a British passport.
Swamy has contended that under Article 9 of the Constitution and the Indian Citizenship Act, 1955, declaration by Gandhi disqualifies him from being an Indian citizen.
In its reply to Swamy's complaint, the Union Home Ministry had pointed out that Gandhi had been shown as a Director and Secretary of a UK-based company, Backops Limited, incorporated in 2003. The company's Annual Returns for October 2005 and October 2006 showed Gandhi's date of birth as June 19, 1970, and mentioned his nationality as British. A dissolution application dated February 17, 2009, also showed Gandhi's nationality as British.
Swamy has pointed out in his petition that despite several letters seeking update on his complaint, the Home Ministry has issued no response or action taken.
"Therefore, this petition seeks that the Home Ministry furnish a status report with regard to the complaint/representation made by the petitioner against Rahul Gandhi and further take a decision on the complaint at the earliest and issue a conclusion or final order," the petition says.
