Maharashtra: Independents, smaller parties fume after being 'ignored'in cabinet expansion

At least two -- Bacchu Kadu and Rajendra Patil-Yadravkar -- expressed a grouse against Shinde-Fadnavis for not giving them any representation in the 20-member ministry comprising 10 Shiv Sena rebels and 10 BJP MLAs. Earlier, the 18 Independents and smaller parties who supported Shinde were assured of adequate representation, and now they have been promised inclusion in the next round of cabinet expansion likely after the Monsoon Session of the Legislature starting on August 17.

Shinde gave indications to the effect in Nanded where he is on a tour on Monday, saying that "you will come to know soon" and the names of the ministers shall be finalised by latter this night or Tuesday. More ministers may be inducted Tuesday - a day ahead of the Monsoon Session of Maharashtra Legislature which is expected to start from Wednesday.

After reaching Delhi on Saturday, Shinde said that he is visiting the national capital to attend the NITI Aayog meeting. More than 35 days have passed after Shinde and Deputy Chief Minister Devendra Fadnavis took the oath of office but cabinet is yet to be expanded. However as per sources, Shinde and Deputy Chief Minister Devendra Fadnavis are already in the capital and may discuss cabinet expansion with the bigwigs of the BJP.

Senior advocate Harish Salve, representing Shinde, submitted that disqualification under the Tenth Schedule of the Constitution takes place, only if the Speaker reaches a conclusion that a member has voted against the stand of a party. Salve added that if the Speaker of an Assembly takes one or two months to decide on disqualification pleas against MLAs, then what does this mean? That they should stop attending the proceedings of the House? He further added, "There is no per se illegality principle, until and unless there is a finding of disqualification..."

Salve replied that the rebel MLAs came to the top court when the then Deputy Speaker of the Maharashtra assembly issued disqualification notices to them, even though a notice against him was pending. Ramana and comprising Justices Krishna Murari and Hima Kohli was hearing petitions filed by the Shiv Sena and its rebel MLAs on constitutional issues of splits, merger, defection, and disqualification. After hearing arguments, the top court asked Shinde's counsel to redraft the submissions on petitions filed by the Uddhav Thackeray faction on constitutional issues, which arise out of the political crisis in Maharashtra.

Shinde said that accepting the argument of the Uddhav Thackeray's faction would result in: "A minority tyranny within the House; anti-democratic and minority Government to continue illegally in office; a Chief Minister, who has lost the confidence of his own party to continue in the office". The petition, filed through advocate Abhikalp Pratap Singh, said petitions filed by Uddhav Thackeray's faction clearly demonstrates that the issues being agitated before the top court have become infructuous by the resignation of the then CM.
