It called upon Omar Abdullah, the former Chief Minister of Jammu and Kashmir, and his estranged wife Payal to try meditation to sort out their differences.
The issue had cropped up before Justices Sudhanshu Dhulia and Ahsanuddin Amanullah; hence, it was said that both parties attempt mediation at the mediation centre of the apex court. "The proposition was readily agreed to by both the senior advocates, Kapil Sibal, appearing for Abdullah and Shyam Diwan for Payal.
It observed that though the marriage might be irreconcilable, yet attempt at mediation had to be made, nevertheless.
Abdullah has filed the appeal against the December 12, 2023 order of the Delhi High Court which confirmed the family court order dismissing his divorce petition against his wife Payal.
The Patiala House Court had in earlier repudiated the divorce petition he had filed in 2013 on the grounds of cruelty. Abduallah and Payal got married in September 1994, and later separated in 2009. They have two sons together.
The Delhi High Court, while rejecting the appeal presented by Abdullah, did not find any kind of infirmity in the impugned order of the family court. Particulars as to cruelty were not there, and it was held that the appellant failed to establish any specific acts of cruelty-whether physical or mental-against his wife. As a matter of fact, the appeal was without merit. Thus, the impugned order passed by the family court dismissing the divorce petition was confirmed.
