Amit Shah Hails the End of 'Tareekh Pe Tareekh Era' with Passage of Criminal Law Bills in Rajya Sabha

The Bill, presented by the Union Home Minister, received approval through a voice vote on Thursday. In the context of the new Criminal law's implementation, Section 375 and Section 376 will be replaced by Section 63 for rape, while gang rape will fall under Section 70.

Union Home Minister Amit Shah, while discussing the new Criminal law Bills in the Rajya Sabha, emphasized that the implementation of these three new Criminal laws would bring an end to the "Tareekh Pe Tareekh Era," ensuring justice is delivered within three years. The Rajya Sabha has successfully passed three crucial Bills—Bharatiya Nyaya (Second) Sanhita, Bharatiya Nagrik Suraksha (Second) Sanhita, and Bharatiya Saksha (Second) Bill. These bills aim to replace outdated British-era laws following a comprehensive day-long discussion in the Upper House.

In the context of the new Criminal law's implementation, Section 375 and Section 376 will be replaced by Section 63 for rape, while gang rape will fall under Section 70. Section 101 will address murder instead of Section 302. These bills have already been endorsed by the Lok Sabha and await approval from President Draupadi Murmu to become law. Following the passage of these Bills, the Rajya Sabha was adjourned indefinitely.

During the discussions, Amit Shah stressed that the bills' objective is not punitive but to deliver justice. He underscored the bills' Indian essence, incorporating concepts from various historical figures such as Vyasa, Brihaspati, Katyayana, Chanakya, Vatsysayana, Devnath Thakur, Jayanta Bhatta, and Raghunatha Shiromani.

The Home Minister highlighted the digitalization of 97% of the country's police stations, with records from 82% being digital. The entire legal process, from filing an FIR to judgment, will be online, with a transition from zero FIRs to only e-FIRs. He assured the House that the justice system established would provide swift, cost-effective justice, and the era of "Tareekh par Tareekh" would end, ensuring victims receive justice within three years.

Shah also discussed the inclusion of a terrorism definition in the criminal justice system, abolishment of the English concept of treason law, and provisions against speaking or acting against the country. The new law aims to expedite justice, reduce costs for the underprivileged, and introduces penalties and punishments for various crimes, including mob lynching. Community service is accepted as punishment in six crimes, with significant changes and additions in various sections of the Bills.
