A bench, headed by CJI D.Y. Chandrachud and comprising Justices P.S. Narasimha and Manoj Misra, expressed its concern over the “headless” institution. “It is sad no one cares about the institution,” remarked Justice Narasimha. The top court indicated that it will temporarily appoint someone on pro tem basis to felicitate functioning of Delhi Electricity Regulatory Commission (DERC) till disposal of the case.

He went on to add that the Parliamentary Standing Committee on Information Technology had sharply observed in 2022 that there is no justification provided by the government that demonstrates in any way that internet shutdowns actually impede, let alone prevent, violence or terrorism anywhere. 

In response to senior advocate Abhishek Manu Singhvi's submission that three hospitals have recommended surgery for Aam Aadmi Party leader and former minister Satyendar Jain, Additional Solicitor General S.V. Raju requested the court for an independent evaluation to be carried out by a panel of doctors from AIIMS in the meantime.

The top court turned down the Enforcement Directorate (ED) plea that Jain should be first examined by a panel of doctors in AIIMS.

The AAP leader also dubbed the ordinance with regard to transfers and postings of officers as "direct contempt" of the Supreme Court's order. He also made an appeal to the Opposition parties to ensure that the bill is not passed in the Rajya Sabha

The apex court issued notice on Jain's plea and also gave him liberty to move the court's vacation bench seeking urgent listing of his plea against a Delhi High Court judgment denying him bail. The bench said, "Issue notice...liberty to move vacation bencha." Additional Solicitor General S.V. Raju appeared for the Enforcement Directorate.
