Sources said in the letter, Rijiju has pointed out the finalisation of the Memorandum of Procedure (MoP) regarding appointment of judges is still "pending", and suggested inclusion of a government representative in the "search-cum-evaluation committee (SEC)", which would provide inputs on suitable candidates to the appointment panel or the collegium.

A bench headed by Chief Justice of India U.U. Lalit told the petitioner's counsel, "We see no reason to entertain the petition, petition is misconceived," and dismissed it. During the hearing in the matter, the petitioner's counsel cited certain "irregularities, illegal acts" allegedly committed by Justice Chandrachud. The bench, also comprising Justices S. Ravindra Bhat and Bela M. Trivedi told the counsel: "We do not see any substance in this petition".

He added, "I become helpless, I cannot answer in definite terms...I have a Lakshman Rekha, which I never dare to cross..." "The country is witnessing a decline in the quality of legislative performance. We have a form of government where the executive is accountable to the legislative. However, space for Leaders of opposition is diminishing in absence of thorough debate and politics has become acronymous. Political opposition should not transform into hostility which is being seen these days which are not signs of healthy democracy," CJI said.
