Sisodia was detained by the CBI on February 26, 2023, due to alleged discrepancies in the creation and execution of the now-defunct Delhi excise policy for 2021-22. Following this, the ED arrested him on March 9, 2023, in a related money laundering case stemming from the CBI’s FIR. He resigned from his position in the Delhi cabinet on February 28, 2023.

As a former Deputy Chief Minister of Delhi, Sisodia has requested bail, arguing that he has been imprisoned for 17 months without the commencement of his trial. Both the ED and the CBI have opposed his bail application. The ED has argued before the Supreme Court that it possesses evidence indicating Sisodia's substantial involvement in the alleged scam.
